1. Introduction

Welcome to Kayaktor. These Terms and Conditions govern your use of our website and services. By accessing or using Kayaktor, you agree to be bound by these terms.

2. Definitions

"Kayaktor," "we," "us," and "our" refer to Naturebox LDA, operating the Kayaktor platform.

"User," "you," and "your" refer to any individual or entity using our services.

"Operator" refers to third-party operators offering trips and experiences through our platform.

"Booking" refers to any reservation made through our platform.

3. Use of Services

You must be at least 18 years old to use our services. By using Kayaktor, you represent that you are at least 18 years of age and have the legal capacity to enter into binding contracts.

You agree to provide accurate, current, and complete information during registration and booking processes.

4. Bookings and Payments

All bookings are subject to availability and confirmation. A deposit of 25% (plus a 2% platform service fee) is required at the time of booking. The remaining balance is charged automatically according to the following schedule:

  • 50% of the trip price (plus 2% service fee) is charged automatically 60 days before departure.
  • 25% of the trip price (plus 2% service fee) is charged automatically 15 days before departure.

By completing a booking, you authorize Kayaktor to store your payment method and process future charges according to this schedule. If a scheduled payment fails, you will be notified by email and given 7 days to update your payment. If payment is not received within 14 days, your reservation may be cancelled.

For bookings made within 60 days of departure, the payment schedule will be adjusted accordingly. Bookings within 15 days of departure require full payment at the time of booking.

All prices are displayed in EUR and include applicable taxes unless otherwise stated. Additional fees may apply for certain services.

We use secure payment processors (Stripe and PayPal) to handle all transactions. We do not store your payment card details.

5. Cancellation Policy

The following cancellation policy applies to all bookings made through the Kayaktor platform:

  • 60+ days before departure: Full refund (free cancellation).
  • 30-59 days before departure: 50% refund of the total amount paid.
  • 0-29 days before departure: No refund.

If a trip is cancelled by the operator due to weather or other circumstances, you will receive a full refund or the option to reschedule.

Refunds are processed within 5-10 business days to the original payment method.

6. Operator Responsibilities

Kayaktor acts as an intermediary between adventurers and suppliers. The actual services are provided by independent third-party suppliers who are responsible for the execution of trips.

While we vet all suppliers for safety and quality standards, we are not liable for the acts or omissions of suppliers.

7. User Conduct

Users agree not to:

  • Provide false or misleading information
  • Use the platform for any unlawful purpose
  • Interfere with the operation of the platform
  • Attempt to gain unauthorized access to our systems
  • Submit fraudulent reviews or ratings

8. Intellectual Property

All content on Kayaktor, including text, graphics, logos, and images, is the property of Naturebox LDA or its licensors and is protected by copyright laws.

9. Limitation of Liability

To the maximum extent permitted by law, Kayaktor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability shall not exceed the amount paid by you for the specific booking in question.

10. Travel Insurance

We strongly recommend purchasing comprehensive travel insurance before your trip. Kayaktor does not provide insurance coverage.

11. Modifications

We reserve the right to modify these terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of Portugal. Any disputes shall be resolved in the courts of Lisbon, Portugal.
